Symposium on celebrating the
EUROPEAN DATA PROTECTION DAY
In order to celebrate the European Data Protection Day, the National Supervisory Authority for Personal Data Processing organised on the 28th January 2016 a symposium on “The protection of personal data within the employment relations”.
The event was attended by important representatives of ministries, public central institutions, the academic medium, NGOs, trade union confederations and the business environment, which illustrates a particular interest in observing the rules on the protection of personal data.
NSAPDP’s president, Mrs. Anca Opre, underlined, in the event’s opening, the importance of observing the rules on personal data protection within the relations between employees and employers, especially the principle of proportionality and ensuring the employees’ right of information, in the context of Recommendation (2015)5 on the processing of personal data in the employment context, recently adopted by the Council of Europe’s Committee of Ministers. This occasion was also used to highlight the need for increased responsibility of employers bearing in mind the importance given to this subject at EU level which will materialise in the first half of this year by the adoption of the Regulation on personal data protection, with direct applicability in all member states.
Mr. Petre Lăzăroiu, judge within the Constitutional Court, underlined the main European and national regulation on the protection of private life and personal data, as well as the important role played by the Supervisory Authority in ensuring an effective exercise of the rights of data subjects.
In the context of the current reform of the legal framework on personal data protection at European level, Mrs. Irina Alexe, deputy secretary general within the Ministry of Internal Affairs, highlighted the constant concern of this ministry in ensuring the observance of the principles on personal data processing and the important cooperation with our office.
One other distinguished guest, prof. univ. dr. Alexandru Athanasiu – representative of the Law School within Bucharest University, brought to the audience’s attention the principles established by the Code of conduct of the International Labour Organisation, which is meant to protect employees within their labour relations.
The effective implementation of the rules on personal data protection at the level of the Public Ministry was presented by Mr. Ilie Picioruş, prosecutor within the public prosecutor’s office within the High Court of Cassation and Justice and the concerns of the National Office of the Commercial Register on observing the rules on the use of data were highlighted by Mrs. Silvia Mihalcea, director general.
The particular interest in monitoring employees within labour relations was illustrated by other guests, both from the point of view of the risks involved within the on-line environment, as well as from a technological, but especially legal point of view, bearing in mind the jurisprudence of the Court of Justice of the European Union and the European Court of Human Rights as well as the national legal framework, particularly as regard penal law.
Within the reunion’s closing, the Supervisory Authority’s president thanked the invitations for the excellent interventions and expressed again our office’s availability to strengthen to cooperation with the public and private sectors in order to ensure an effective observance of the right to private life.
